Has Texas outlawed all marriages?

Fri 20 Nov 2009 In: International News View at Wayback

In its effort to outlaw same-sex marriages, Texas has accidentally banned all marriages, claims a Democratic candidate for attorney general. Barbara Ann Radnofsky points out that the state's constitutional amendment states "this state or political subdivision of this state may not create or recognize any legal status identical or similar to marriage." This effectively "eliminates marriage in Texas," argues Radnofsky, so was "a huge mistake." Radnofsky's critics are accusing her of just trying to stir up the debate about gay marriage again. A spokesman for current attorney general Greg Abbott, who approved the wording, dismissed her claims, saying: "The Texas constitution and the marriage statute are entirely constitutional."
